LAS VEGAS (KLAS) — A Las Vegas woman who is recovering after being shot in the eye while driving through an apartment complex is now suing the property owner.

Martha Carbajal was shot on Oct. 5 while driving in the early evening through Vera Johnson Manor near Lamb Boulevard and Bonanza Road.
Carbajal is still in distress, mentally and physically.

“I have pain every single day and maybe within time, everything I’m feeling will eventually leave my mind, but it’s so hard right now,” Carbajal said.
While she waits for her prosthetic eye, Carbajal has filed a lawsuit against Nevada Hand, the property owner. The lawsuit argues Nevada Hand should take full responsibility for what happened to her.
The apartment complex where Carbajal was shot is Section 8 housing.
Carbajal’s attorneys at Ace Law Group told 8 News Now that despite a history of violent crime, Vera Johnson Manor has yet to take action to secure the premises. Lawyers cited a list of service calls obtained from the Las Vegas Metropolitan Police Department.

“The apartment complex is in a high crime area and the complex has a responsibility to make sure there is adequate security for those who live there, but also for visitors of the property,” Ace Law Group’s Patrick W. Kang said.
Kang also said that in addition to adding onsite security, there are other ways the complex could have taken action before the shooting occurred.
“There are a number of tools they could have utilized like leasing agreements to expel problem residents,” Kang said.
Metro police are investigating the shooting and looking for the suspects involved. Anyone with information is urged to call Crime Stoppers at (702) 385-5555 to remain anonymous.

Carbajal has been referred to a neurosurgeon, neurologist and a psychiatrist who can help as she says she is now experiencing cognitive and speech problems.
The Carbajal family has created a GoFundMe page to help with medical costs.
