Energy: Arbitration and Justice – Brazil
I have been called to act in both Arbitration and Justice regarding disputes between buyers and sellers of electric energy.
The good news is that both modalities have been correct, basing their decisions on the established rules. And this is great! It gives peace of mind to the parties.
The only issue that always catches my attention is the delay. Several years between the beginning and the conclusion.
In the United States, where I had an experience involving arbitration, the conclusion required 3 months.
Brazil would have a lot to gain by being more efficient – than it is, also in this area. Investors would have more institutional security and thus would be more attracted to developing business in Brazil. More jobs, more income and more of everything good!
